Leesburg Man Sentenced For Sexual Battery

WARSAW — A Leesburg man will serve one year on probation for sexually touching a person without their consent.

Paul Jay Comer Jr., 33, 6908 E. May Lane, Leesburg, was charged with sexual battery, a level 6 felony.

Comer was sentenced in Kosciusko Superior Court One on Thursday, June 20.

Kosciusko Superior Court One Judge Karin McGrath sentenced Comer to one year and four months in the Kosciusko County Jail, with four months executed and one year suspended on formal probation.

Comer has 70 days of jail time credit.

A no-contact order between Comer and the victim remains in effect. Comer must also register as a sex offender.

At sentencing, Deputy Prosecutor Jennifer Naue said the victim was in agreement with the proposed plea agreement and asked the court to sentence Comer according to its terms.

McGrath told Comer his plea was favorable, noting a previous conviction he has for sexual misconduct with a minor.

On July 13, 2023, Kosciusko County Sheriff’s Office deputies spoke with an individual who said they were raped by Comer.

According to court documents, the person said they had consensual sex with Comer on July 12, 2023. However, Comer tried to have sex with the person a second time without their consent. The person said Comer forced himself onto them even though the person told Comer to stop about 20 times.

Comer told deputies the person said “no” as if to say “you’re not attracted to me” and not as if to say “no get off of me.” He also said he was a registered sex offender.
