WARSAW — A Warsaw woman was arrested for allegedly operating a vehicle under the influence while two children were in her vehicle.
Brittany Lynn Curto, 33, 2438 S. Woodland Trail, Warsaw, is charged with operating a vehicle with an ACE of 0.15 more with a passenger under 18 years of age and two counts of neglect of a dependent, all level 6 felonies; and operating a vehicle with an alcohol concentration equivalent to 0.15 or more, a class A misdemeanor
On June 21, Kosciusko County Sheriff’s Office deputies responded to a report of a reckless driver in Warsaw. A woman said she followed the driver and saw two children inside the vehicle.
The woman said she saw the vehicle weaving and jerking back into its lane of travel multiple times. According to court documents, when she drove by, the vehicle swerved into her driving lane, nearly causing a collision. She provided a description of the vehicle and its driver to officers. The woman also obtained video of the driver, which showed the vehicle driving almost completely to the right of the road’s fog line, in an area with several utility poles clustered together.
Deputies located the suspect vehicle at a residence and checked the two children, who appeared fine.
Deputies spoke with the residence’s homeowner, who said the vehicle’s driver, later identified as Curto, made dangerous decisions with alcohol. He said he repeatedly expressed his concern to Curto regarding excessive alcohol consumption.
The deputies then spoke with Curto, who was exhibiting physical signs of intoxication. Her clothing description also matched what was provided by the woman who reported the incident. Curto failed three field sobriety tests and a certified chemical test resulted in a 0.24% BrAC.
Curto has already been arrested and released on bond. She has an initial hearing at 1 p.m. Wednesday, July 3, in Kosciusko Superior Court Three.
